For decades, the common wisdom about UK defamation law was simple: it was a difficult, expensive, and intimidating route to justice. Libel, in contrast, relates to written or recorded defamation — whether that be in a newspaper, a public forum, or increasingly today, on social media platforms and websites.


While the legal distinction between the two might sound simple, it has led to very different hurdles for claimants. In slander cases, unless the statement falls within certain special categories — such as accusing someone of a crime — the victim must prove that they suffered actual damage as a result. Libel, however, presumes damage because the words are recorded and can spread, harming reputation even long after the fact.


For many years, pursuing either kind of claim was daunting. Defamation cases have a reputation for being complex, expensive, and stacked in favour of the defendant, especially in the digital age where anonymous or pseudonymous actors can wreak havoc on a person’s reputation while seemingly remaining untraceable.


Yet in the last few years, several forces have begun to shift the balance toward victims — and technology is playing a major role.


Where once online abuse and smear campaigns were hard to prove, forensic investigators today can recover, analyse, and connect digital evidence in ways that were unthinkable even a decade ago. AI is becoming a crucial ally in this space. Modern forensic techniques can piece together patterns of online behaviour across multiple platforms, analyse metadata from digital files, and uncover the identities of those behind anonymous profiles.


This is especially important because in today’s world, defamation rarely occurs in isolation. Increasingly, victims find themselves facing coordinated campaigns of harassment that include not just slander or libel, but stalking, harassment, and what is now referred to as stalking by proxy. Here, a perpetrator may recruit or manipulate others — sometimes knowingly, sometimes not — to spread defamatory statements or participate in a wider effort to isolate or damage the victim.


Previously, victims of such tactics faced an almost impossible challenge in proving the existence of an organised campaign. They might know in their gut that they were being targeted, but struggled to produce the kind of coherent, admissible evidence that courts require. Now, with the help of AI-powered tools, forensic investigators can map networks of accounts that systematically share defamatory content, link patterns of activity to specific times and places, and even correlate these actions with offline events.


For example, AI models can scan thousands of posts and messages to identify language patterns that point to a common author or instigator. Device forensics can reveal that supposedly separate online identities were in fact controlled by the same person. Deleted messages and content — once thought safely vanished — can often be recovered and used to demonstrate both the existence of defamation and the intent behind it.


This kind of evidence is increasingly persuasive in court. Judges are becoming more aware of the reality of online harm and more willing to consider how modern reputation damage unfolds in the digital space. The introduction of the Defamation Act 2013 was a significant step forward, creating a clearer legal test by requiring claimants to show that defamatory statements caused or likely to cause"serious harm." Initially seen as a potential barrier, this requirement has in practice helped focus courts on the true impact of defamatory campaigns, particularly when combined with the depth of evidence now possible through AI and forensic analysis.


Importantly, technology is also helping to bring slander cases out of the shadows. Spoken defamation is notoriously difficult to prove, as it often takes place in private settings without obvious witnesses. However, the ubiquity of smartphones and recording devices has changed this. Increasingly, victims are able to produce authenticated recordings of slanderous remarks — and AI-assisted audio forensics can verify their authenticity and link them to specific contexts and individuals.


Similarly, video analysis powered by deep learning can detect when manipulated or doctored content is being used as part of a smear campaign. Where perpetrators once relied on editing tools to create plausible deniability, AI is now able to detect subtle inconsistencies that betray fakery and manipulation.


Beyond the courtroom, there is a broader cultural shift under way. Public understanding of the psychological and professional harm caused by defamation is growing. Employers, professional bodies, and regulators are increasingly recognising that reputational harm can have devastating consequences even when legal proceedings are not brought. Victims of stalking by proxy and coordinated harassment campaigns are beginning to find more sympathetic audiences in both legal and professional settings — and the ability to present clear, technology-backed evidence is critical to this progress.


Of course, these developments also come with new challenges. AI itself can be weaponised to create deepfakes or automate smear campaigns. But the same technological arms race that enables new forms of defamation is also empowering victims and investigators to fight back. The tools to analyse, expose, and counter reputational harm are becoming more sophisticated and more accessible.


What we are witnessing, then, may be the beginning of a new era in UK defamation law and in the fight against reputational harm more broadly. Technology, legal reform, and changing cultural attitudes are converging to create new pathways to justice. No longer do victims have to accept that anonymous or covert smear campaigns are beyond their ability to prove. With the right support, expertise, and forensic tools, it is increasingly possible to shine a light on these hidden harms — and to hold those responsible to account.


The tide is turning — and those who once operated in the shadows should take note.
